1. Agreement and service
These terms govern your use of Upaya, provided by tlpth labs GmbH. Upaya lets people create, organise, collaborate on, follow, and share buckets, collections, and entries. By creating an account or using the service, you agree to these terms and the Privacy Policy.
2. Your account
You must provide accurate account information, keep your sign-in details secure, and promptly tell us about suspected unauthorised access. You are responsible for activity under your account. You must be at least 16, or have permission from a parent or legal guardian where required.
3. Your content and permissions
You retain ownership of content you add to Upaya. You grant us a non-exclusive licence to host, process, resize, display, and transmit it only as needed to operate the service and honour your visibility and sharing choices. You confirm that you have the rights needed to upload or share that content.
4. Acceptable use
- Do not upload unlawful, abusive, deceptive, infringing, or privacy-invasive content.
- Do not access another person’s private content without permission or share private links beyond their intended audience.
- Do not probe, overload, disrupt, reverse engineer, or misuse the service or its import features.
- Do not automate collection or publication in a way that violates a third party’s terms or rights.
- Do not impersonate others or manipulate follows, likes, reports, or recommendations.
5. Collaboration and sharing
Owners control a bucket’s visibility and collaborator access. Collaborators may be able to add, edit, or delete shared content as indicated in the app. Public content can be copied, indexed, or reshared by others. Expiring private links reduce exposure but cannot prevent recipients from saving what they can view.
6. Third-party content and suggestions
Link previews, imported metadata, maps, opening hours, external images, and AI-assisted suggestions may be incomplete, unavailable, or inaccurate. Upaya is an organisation and discovery tool, not a source of professional, legal, financial, medical, safety, or purchasing advice. Check important details at the original source.
7. Availability and changes
We operate Upaya with reasonable care but do not promise uninterrupted availability, permanent storage, or that every external integration will continue to work. We may improve, replace, limit, or discontinue features. We will provide reasonable notice where a material change adversely affects users.
8. Suspension and termination
You may stop using Upaya and delete your account at any time. We may restrict or terminate access where reasonably necessary to protect users or the service, comply with law, or respond to a serious or repeated breach of these terms. Where practical, we will explain the reason and allow an appeal.
9. Liability
To the extent permitted by law, Upaya is provided without guarantees beyond those expressly stated. tlpth labs GmbH is not liable for indirect or consequential loss, lost content, decisions based on third-party or generated information, or events outside our reasonable control. Liability for intent, gross negligence, personal injury, and other liability that cannot legally be excluded remains unaffected.
10. Governing law and contact
Swiss law applies, excluding conflict-of-law rules. The courts of Zürich, Switzerland have jurisdiction where mandatory consumer law does not require another forum. Questions can be sent to florian@tlpth-labs.com.
